From 1912, Alejandro Korn and José Ingenieros began to publish articles that then would be part of their historical works, respectively, Influencias filosóficas en la evolución nacional and La evolución de las ideas argentinas. Therefore, they started to generate some discussion in reference to sections that they knew of each other's work. Being the first major works from a developing philosophical field about the history of Argentine thought, their authors sought to create cultural traditions to affirm their own academic, (...) cultural and political positions. Thus, they based their positions about their academic situation through their interventions in the debate on the evaluation of the various features of the intellectual past of the country and national identity during the academic professionalization of historical studies, and actively participated in discussions on the function of culture and philosophy in a national project. Yet, besides, in order to address their history of ideas, the two most important teachers of the philosophical sphere around 1918 tested very different methodological approaches that worked under different conceptions of philosophical and historical practice and two different ways of thinking the reception and circulation of ideas from Europe. Resilience Tutors is the title of the book written by Gema Puig Esteve and JoséLuis Rubio Raval, published in 2015 by the Gedisa publishing house in Barcelona, Spain. In a novel way, the book, divided into two, expresses in the first part, in a fictional way, through experiential, emotional and direct language, the reality surrounding the resilience tutor; In the second part, it gives us concrete theoretical elements that allow us to delve deeper into the foundations of resilience, the (...) contexts in which it develops and the characteristics of resilience tutors. We could summarize the theme of the book in a poetic way with a few words from Espinosa (Cited in Rubio and Puig, 2015): “Every year of my life I have searched for twelve pearls. Twelve people that I did not know, but who appeared to me and marked my world in such a way that my self changed (...) Over time some pearls become diamonds (...) a diamond, so that you understand me, is one of those people who become so basic and so important in your life that they seem created solely for you” (p. 49). -/- Tutores de Resiliencia es el título del libro escrito por Gema Puig Esteve y JoséLuis Rubio Raval, publicado en el 2015 por la editorial Gedisa en Barcelona,España. De manera novedosa el libro, dividido en dos, expresa en la primera parte,de manera novelada, a través de un lenguaje vivencial, emotivo y directo, la realidad entorno al tutor de resiliencia; en la segunda parte, nos da elementos teóricos concretos que permiten profundizar en los fundamentos de la resiliencia, los contextos en los que se desarrolla y las características de los tutores de resiliencia. Mimesis can refer to imitation, emulation, representation, or reenactment - and it is a concept that links together many aspects of ancient Greek Culture. The Western Greek bell-krater on the cover, for example, is painted with a scene from a phlyax play with performers imitating mythical characters drawn from poetry, which also represent collective cultural beliefs and practices. One figure is shown playing a flute, the music from which might imitate nature, or represent deeper truths of the cosmos based upon (...) Pythagorean views (which were widespread in Western Greece at the time). The idea that mimesis should be restricted to ideals was made famous by Plato (whose connections to Pythagoreanism and Siracusa are well-known), and famously challenged by his student Aristotle (not to mention by the mimetic character of Plato’s own poetry). This volume gathers essays not only on the philosophical debate about mimesis, but also on its use in architecture, drama, poetry, history, music, ritual, and visual art. It is now the majority view amongst philosophers and theologians that any world could have been better. This places the choice of which world to create into an especially challenging class of decision problems: those that are discontinuous in the limit. I argue that combining some weak, plausible norms governing this type of problem with a creator who has the attributes of the god of classical theism results in a paradox: no world is possible. After exploring some ways out of (...) the paradox, I conclude that the classical theist should accept Marilyn Adams’s view that no norms apply to gods. (shrink)

In his work on the open future, Patrick Todd outlines three models of how to deal with future contingents. These models must answer two questions: one metaphysical, about what facts there are in the world; one semantic, about how to deal with sentences involving ‘will.’ Model 1 has a privileged timeline. Model 2 has an actual future timeline but leaves it indeterminate which timeline that is. Model 3 has no future timeline. All three give will-sentences a modal treatement, as a (...) box over available futures. I will argue that Todd’s second model has problems and should be improved. The first is that it denies what Todd labels as the basic metaphysical intuition behind open-futurism. The second is that indeterminacy about the facts that characterize the actual timeline breaks through into indeterminate identity. I propose a fix to model 2 eliminating its actual future and resolving an issue that arises in applying the neutral semantics Todd endorses to indeterminate sentences. This improved model, I suggest, may even compare favorably to Todd’s preferred model 3. (shrink)

Recent work in the philosophy of religion has resurrected Leibniz’s idea that there is a best possible world, perhaps ours. In particular, Klaas Kraay’s [2010] construction of a theistic multiverse and Nevin Climenhaga’s [2018] argument from infinite value theory are novel defenses of a best possible world. I do not think that there is a best world, and show how both Kraay and Climenhaga may be resisted. First, I argue that Kraay’s construction of a theistic multiverse can be resisted from (...) plausible assumptions about set theory. Next, I argue against the value-theoretic assumptions that underlie Climenhaga’s argument and show how to give an infinite value theory where there is no best world. (shrink)

Molinists offer a tempting bargain: accept divine middle knowledge, and reap solutions to a number of philosophical/theological problems. The prime benefit we are meant to reap from middle knowledge is a solution to the problem of freedom and providence. I argue that they cannot deliver. Even if we make metaphysical and semantic assumptions that have generally been considered friendly to Molinism, Molinism is in danger of undermining divine providence altogether. This “collapse" persists despite fairly uncontroversial assumptions, and plagues the best (...) Molinist theories defended in the literature. (shrink)

Recent analytic theology has seen a wave of excellent work on the fundamental problem of Christology, the question of how one and the same person can be human full stop and divine full stop. Along the way, new objections have been raised for a venerable family of Christological views, whose distinctive is the employment of qua-devices to dissolve the difficulties stemming from the dual nature doctrine of Chalcedon and its successors. My objective in this article is twofold. First, I propose (...) to lay out a hierarchy of principles that should guide the search for a Christological theory. I then use these principles to illuminate the best qua-theoretic approach to Christology. Finally, I argue that the best qua-theory is at worst on a par with major recent views. (shrink)

Erik Wielenberg [2014] and Mark Murphy [2017], [2018] have defended a series of arguments for the conclusion that creatures are not good intrinsically. In response, I take two steps. First, I introduce a conception of intrinsic value that makes created intrinsic value unproblematic. Second, I respond to their arguments in turn. The first argument is from the sovereignty-aseity intuition and an analysis of intrinsicality that makes derivative good extrinsic. I challenge the analysis. The second comes from a conception of perfection (...) where God exhausts all possibilities for goodness. I challenge this conception. The third comes from the contingency of creation and the internal logic of intrinsic value. I challenge the assumption that connects the two. I then present an argument from reference magnetism that the only conception of God, God's perfections, and religious language that makes it plausible that the sentence "God is intrinsically good and creatures are not" is true involves a strongly univocalist position. A view that is either unstatable or places strong demands on our conception of God, God's perfections and religious language thereby loses plausibility. (shrink)

Jim Sterba’s Is a Good God Logically Possible? looks to resurrect J. L. Mackie’s logical argument from evil. Sterba accepts the general framework that theists seeking to give a theodicy have favored since Leibniz invented the term: the search for some greater good provided or greater evil averted that would justify God in permitting the type and variety of evil we actually observe. However, Sterba introduces a deontic twist, drawing on the Pauline Principle (let us not do evil that good (...) may come) to introduce three deontic side constraints on God’s choice of action. He then splits the possible goods into four categories: first- vs. second-order goods, goods to which we have a right, and goods to which we do not have a right. He argues that his deontic constraints rule out each combination, thereby showing that no God-justifying good is on offer. To defuse the argument, I draw on a pair of ideas from Marilyn McCord Adams: (i) God is outside the bounds of morality, and (ii) God can defeat evils by incorporating them into an incommensurately valuable friendship with each human. Properly appreciated, these show that the new logical argument relies on a false premise that is not easily repaired. (shrink)

Quine taught us the difference between a theory’s ontology and its ideology. Ontology is the things a theory’s quantifiers must range over if it is true, Ideology is the primitive concepts that must be used to state the theory. This allows us to split the theoretical virtue of parsimony into two kinds: ontological parsimony and ideological parsimony. My goal is help illuminate the virtue of ideological parsimony by giving a criterion for ideological innocence—a rule for when additional ideology does not (...) count against parsimony. I propose the expressive power innocence criterion: if the ideology of theory one is expressively equivalent to that of theory two, then neither is ideologically simpler than the other. In its favor I offer the argument from accuracy, showing that any account of a theoretical virtue that is supposed to make theories that have it more likely to be true than theories that do not must respect it. Next I consider its ramifications, eliminating rival views and passing judgment on some arguments from parsimony that can be found in the literature. Finally, I consider two objections. First: I address an objection arising from the possibility of languages with a ‘primitive’ operator that allows us to list a theory’s primitives in the object-language. Second: I address an objection raised by Nelson Goodman against attempts to reckon simplicity by expressive power. Both objections fail. (shrink)

Epicurus (in)famously argued that death is not harmful and therefore our standard reactions to it (like deep fear of death and going to great lengths to postpone it) are not rational, inaugurating an ongoing debate about the harm of death. Those who wish to resist this conclusion must identify the harm of death. But not any old harm will do. In order to resist both the claim that death is not harmful and the claim that our standard reactions to it (...) are irrational, we must identify a harm associated with death that rationalizes our standard reactions. We can divide the potential harm properties death might have along two axes: intrinsic/extrinsic and instrumental/final. This gives us four places to search for the harm of death. The article examines the first Hebrew Encyclopedia of Science, Yesodei ha-Tvunah u-Migdal ha-Emunah, by Medieval Jewish scholar Abraham Bar Hiyya from Saragossa (Iberian peninsula).

Although expected utility theory has proven a fruitful and elegant theory in the finite realm, attempts to generalize it to infinite values have resulted in many paradoxes. In this paper, we argue that the use of John Conway's surreal numbers shall provide a firm mathematical foundation for transfinite decision theory. To that end, we prove a surreal representation theorem and show that our surreal decision theory respects dominance reasoning even in the case of infinite values. We then bring our theory (...) to bear on one of the more venerable decision problems in the literature: Pascal's Wager. Analyzing the wager showcases our theory's virtues and advantages. To that end, we analyze two objections against the wager: Mixed Strategies and Many Gods. After formulating the two objections in the framework of surreal utilities and probabilities, our theory correctly predicts that (1) the pure Pascalian strategy beats all mixed strategies, and (2) what one should do in a Pascalian decision problem depends on what one's credence function is like. Our analysis therefore suggests that although Pascal's Wager is mathematically coherent, it does not deliver what it purports to, a rationally compelling argument that people should lead a religious life regardless of how confident they are in theism and its alternatives. This article explores how externalism about reasons for action contributes to understanding the relations between agents and norms. In order to do this, firstly, the distinction between internalism and externalism is presented; secondly, some flaws of internalism regarding the objectivity of duties are analysed; lastly, externalism is defend-ed from the criticism according to which the principle «ought implies can» cannot be explained.

Thomas Aquinas wrote a text later known as Quaestio de attributis and ordered it inserted in a precise location of his Commentary on the Sentences of Peter Lombard more than a decade after composing this work. Aquinas assigned exceptional importance to this text, in which he confronts the debate on the issue of the divine attributes that swept the most important centres of learning in 13th Century Europe and examines the answers given to the problem by the representatives of the (...) four mainstream schools of his time: the Greek mystic Dionysius Areopagita, the Latin Saint Anselm of Canterbury, the Jewish rabbi Moses Maimonides and the Muslim philosopher Ibn Sina. This in-depth study of Thomas Aquinas’ Quaestio de attributis (In I Sent., d. 2, q. 1, a. 3) binds together the findings of previous research on the unique history of this text by reconstructing the historical circumstances surrounding its composition, shows that the Quaestio contains Aquinas’ final answer to the dispute on the divine attributes, and thoroughly examines his interpretation of Maimonides’ position on the issue of the knowledge of God by analysing this and other texts related to it chronologically and doctrinally. The examination of the Quaestio reveals the background of Thomas Aquinas’ renewed interest in Maimonides’ position on the issue and brings to light elements of Aquinas’ interpretation that are absent from his earlier references to Maimonides. Moreover, the chronological and doctrinal connection of the Quaestio de attributis to other Thomistic works with explicit references to Maimonides enables a reconstruction of his comprehensive approach to Maimonides’ teaching on the possibility and extent of the knowledge of God in the Guide of the Perplexed and highlights the place of Maimonides’ philosophical teachings in Thomas’ own thought in issues like "Being" as the proper name of God, the multiplicity of the divine names, the beatific vision in the afterlife, the causes that prevent the instruction of the multitude in divine matters and the role of faith and prophecy in the acquisition of the true knowledge of God in this life. The last chapter examines the reasons behind Aquinas’ silencing of Maimonides’ name when introducing his Five Ways for the knowledge of the existence of God, in spite of the evident relation between these and Maimonides’ Four Speculations. The study is completed with an extensive appendix that includes the text of the Quaestio de attributis with an English translation and the critical edition of several chapters of the 13th Century Latin translation of the Guide of the Perplexed known as Dux neutrorum. This paper compares the concepts of “spirit” and “dialectic” in Hegel’s Phenomenology of Spirit and Kierkegaard’s The Sickness unto Death respectively. For this purpose, I delve into the way in which both philosophers understand these two concepts. The aim of this comparison is to detect whether there is some kind of relationship between the two concepts that could bring Hegel and Kierkegaard closer to each other.

Abstract: The present text compare the concepts of Spirit and Dialectic in Hegel's Phenomenology of Spirit and Kierkegaard's Sikness unto Death respectively. For this, the clarifications made by one author and the other of the concepts to be compared are taken, as a starting point, in order to detect whether or not these concepts have some kind of relationship that serves to bring german and danish closer together. -/- .

Molinists hold that there are contingently true counterfactuals about what agents would do if put in specific circumstances, that God knows these prior to creation, and that God uses this knowledge in choosing how to create. In this essay we critique Molinism, arguing that if these theses were true, agents would not be free. Consider Eve’s sinning upon being tempted by a serpent. We argue that if Molinism is true, then there is some set of facts that fully explains both (...) Eve’s action and everything else Eve does that influences that action; and that if this is the case, Eve does not act freely. The first premise of this argument follows from the explanatory relations the Molinist is committed to, and the second premise follows from libertarian intuitions about free will. (shrink)

The present text sets out to determine the relationships between the concepts of despair and selfhood in Søren Kierkegaard's Sikness unto Death. For this, a hermeneutic, as exhaustive as possible, is applied to the discernment of the concept itself, to later relate it to what the Danish calls despair. After clarifying the relationship between both concepts, examples of the desperate Kierkegaardian man abound in order to verify the irremediable discordance between the constituent elements of the self-given, his unresolved relationship with (...) This text aims to contrast the metaphysical beginnings of the philosophies of Hegel and Kierkegaard. For this task, the notion of Being Pure of the Hegel of Logic will be used in relation with the concept of Irony that Kierkegaard expresses in his Concept of irony. The need for this "contrast of beginnings" seeks to clarify, from a “metaphysical awakening”, the evident theoretical courtship that has so far distanced by the dominant historiographical traditions of continental philosophy.

No existe eso de “léete tal libro suyo que de ahí en adelante entenderás todo con mucha más claridad”, o aquel otro consejo de “a partir de tal idea puedes conectar las partes con el todo”. No. En la acaparadora obra de Han no hay nada de eso. Por el contrario, toda su producción intelectual parece (...) estar guiada más por un ánimo apocalíptico de anunciaciones fatalistas que por un sistema lógico de relaciones de ideas. La palabra, como medio para comunicar y enunciar ideas con cierta claridad, es (re)emplazada en su obra por un discurso emotivo donde prima la cicatriz sobre la herida, el moretón sobre el golpe, el efecto sobre la causa. Clinical delusions are widely characterized as being pathological beliefs in both the clinical literature and in common sense. Recently, a philosophical debate has emerged between defenders of the commonsense position (doxasticists) and their opponents, who have the burden of pointing toward alternative characterizations (anti-doxasticists). In this chapter, I argue that both doxasticism and anti- doxasticism fail to characterize the functional role of delusions while at the same time being unable to play a role in the explanation of these phenomena. I (...) also argue that though a more nuanced view of belief in which mental states are more or less belief-like instills a healthy skepticism towards the precision of folk-psychological concepts, such a stance fails to be of use in building a theory of delusion that will be able to bridge different levels of explanation, such as the phenomenology and neurobiology of delusion. Thus, I advocate moving past the question ‘Are delusions beliefs?’ and their description as propositional attitudes toward the description of the processes that generate delusion, with a view toward explaining, rather than explaining away, the personal-level aspects of the phenomenon that have been made inscrutable by investing in doxastic terminology. This article aims to review the standard objections to dualism and to argue that will either fail to convince someone committed to dualism or are flawed on independent grounds. I begin by presenting the taxonomy of metaphysical positions on concrete particulars as they relate to the dispute between materialists and dualists, and in particular substance dualism is defined. In the first section, several kinds of substance dualism are distinguished and the relevant varieties of this kind of dualism are selected. The (...) remaining sections are analyses of the standard objections to substance dualism : It is uninformative, has troubles accounting for soul individuation, causal pairing and interaction, violates laws of physics, is made implausible by the development of neuroscience and it postulates entities beyond necessity. Given the oncoming demographic changes—which are primarily driven by the growth in the Latinx community—the United States is predicted to become a minority-majority country by around 2050. This seems to suggest that electoral strategies that employ “dog-whistle” politics are destined for the dust-bin of history. Following the work of critical race theorists, such as Ian Haney-Lopez and Derrick Bell, I want to suggest that pronouncing the inevitable demise of dog-whistle politics is premature. This is because there are reasons to suspect (...) that certain segments of the Latinx community—much like the Southern and Eastern Europeans in the early part of 20th Century—might be co-opted into American whiteness. Education is essential to life, and the epidemic affected everything. Parents want to get their kids the most important teaching. However, since COVID-19 has affected schools and other institutions, providing education has become the most significant issue. Online learning pedagogy uses technology to provide high-quality learning environments for student-centered learning. Further, this study explores the experiences and challenges faced by Filipino tertiary students regarding the lack of gadgets amidst online learning. Employing the Interpretative Phenomenological Analysis, the findings of this study (...) were: Some college students still have difficulty with online learning. Attending online classes is difficult, especially for students with limited resources. Smartphones, other gadgets, and internet connections play a significant role in online classrooms because they are the ones that students utilize while learning online, which is essential for successful participation in online higher education as well as for solving a variety of other difficulties in the new normal. Further, College students face similar health challenges. Having an online learning setup is not just about students' struggles with learning resources but also about their health issues. When our respondents used their smartphones for an extended period, they reported eye aches and blurred vision. Even though college students continue to suffer from a lack of learning resources during online sessions, they do their best to manage their needs and the scarcity of learning resources. Apremia descentralizar gestiones administrativas y que cada individuo sea responsable y participante, coinciden. Las motivaciones efectivas han de convertir al trabajo en primera necesidad y, junto a la educación de la familia, borrar la cultura del "rebusque". Formar en los valores del trabajo debe encontrar sustento en la realidad y sus ejemplos.

In debating the ethics of immigration, philosophers have focused much of their attention on determining whether a political community ought to have the discretionary right to control immigration. They have not, however, given the same amount of consideration to determining whether there are any ethical limits on how a political community enforces its immigration policy. This article, therefore, offers a different approach to immigration justice. It presents a case against legitimate states having discretionary control over immigration by showing both how (...) ethical limits on enforcement circumscribe the options legitimate states have in determining their immigration policy and how all immigrants (including undocumented immigrants) are entitled to certain protections against a state’s enforcement apparatus. Este trabajo pretende mostrar las líneas generales de la propuesta humeana de una teoría de la evolución de las instituciones en clave utilitarista; en segundo lugar, analizará la objeción interna a esta teoría que supone la existencia de posibles sujetos no cooperadores pero inteligentes, en tercer lugar, intentará también defender dicha teoría de la acusación externa de no tener un auténtico carácter normativo; y al no haber desarrollado el propio Hume con detalle su contestación al problema del conflicto Moral/Racionalidad, tal (...) y como surge en el contexto de su discusión de la Knavery, finalmente, y en cuarto lugar, este trabajo, yendo en un cierto sentido algo más allá de lo propuesto por Hume, ensayará un argumento post-humeano en torno a ese conflicto, basado, por una parte, en el reconocimiento de la multidimensionalidad de la Moral, así como en la paralela aceptación de la necesidad de un ajuste contextual de ésta, asentado sobre consideraciones primaria, que no exclusivamente, utilitaristas. Además de la selección de fragmentos que integra la antología, José Ramón Fabelo Corzo escribe el Prólogo (que busca ubicar a Frondizi en el contexto histórico del pensamiento axiológico latinoamericano) y el Epílogo (en el que se realiza una valoración crítica de las propuestas de este destacado pensador argentino.

I assess Tamar Gendler's (2007) account of self-deception according to which its characteristic state is not belief, but imaginative pretense. After giving an overview of the literature and presenting the conceptual puzzles engendered by the notion of self-deception, I introduce Gendler's account, which emerges as a rival to practically all extant accounts of self-deception. I object to it by first arguing that her argument for abandoning belief as the characteristic state of self-deception conflates the state of belief and the process (...) of belief-formation when interpreting David Velleman's (2000) thesis that belief is an essentially truth-directed attitude. I then call attention to the fact that Velleman's argument for the identity of motivational role between belief and imagining, on which Gendler's argument for self-deception as pretense depends, conflates two senses of 'motivational role'-a stronger but implausible sense and a weaker but explanatorily irrelevant sense. Finally, I introduce Neil Van Leeuwen's (2009) argument to the effect that belief is the practical ground of all non-belief cognitive attitudes in circumstances wherein the latter prompt action. I apply this framework to Gendler's account to ultimately show that imaginative pretense fails to explain the existence of voluntary actions which result from self-deception. (shrink)

The notion of habit used in neuroscience is an inheritance from a particular theoretical origin, whose main source is William James. Thus, habits have been characterized as rigid, automatic, unconscious, and opposed to goal-directed actions. This analysis leaves unexplained several aspects of human behavior and cognition where habits are of great importance. We intend to demonstrate the utility that another philosophical conception of habit, the Aristotelian, may have for neuroscientific research. We first summarize the current notion of habit in neuroscience, (...) its philosophical inspiration and the problems that arise from it, mostly centered on the sharp distinction between goal-directed actions and habitual behavior. We then introduce the Aristotelian view and we compare it with that of William James. For Aristotle, a habit is an acquired disposition to perform certain types of action. If this disposition involves an enhanced cognitive control of actions, it can be considered a “habit-as-learning”. The current view of habit in neuroscience, which lacks cognitive control and we term “habit-as-routine”, is also covered by the Aristotelian conception. He classifies habits into three categories: (1) theoretical, or the retention of learning understood as “knowing that x is so”; (2) behavioral, through which the agent achieves a rational control of emotion-permeated behavior (“knowing how to behave”); and (3) technical or learned skills (“knowing how to make or to do”). Finally, we propose new areas of research where this “novel” conception of habit could serve as a framework concept, from the cognitive enrichment of actions to the role of habits in pathological conditions. In all, this contribution may shed light on the understanding of habits as an important feature of human action. Habits, viewed as a cognitive enrichment of behavior, are a crucial resource for understanding human learning and behavioral plasticity. (shrink)

A critical exposition, in Spanish, of Erving Goffman's theories on the semiotic organization of social reality and on the structure of subjectivity and subjective experience (two sides of the same coin) through a detailed analysis of the conclusion to Frame Analysis (1974). Goffman's insights into the interactional nature of subjectivity are related to other theorists' conceptions of the role of reflexivity in perception, consciousness and the structuring of semiotic artifacts (language, narrative, art).

This chapter connects the phenomenon of double bookkeeping to two critical debates in the philosophy of delusion: one from the analytic tradition and one from the phenomenological tradition. First, I will show how the failure of action guidance on the part of some delusions suggests an argument to the standard view that delusions are beliefs (doxasticism about delusion) and how its proponents have countered it by ascribing behavioral inertia to avolition, emotional disturbances, or a failure of the surrounding environment in (...) supporting the agent’s motivation to act. Second, I will show how the mismatch between the experience of double bookkeeping and that of having the usual propositional attitudes of folk psychology suggests another, more recalcitrant argument not only against doxasticism but against the very attempt to fit delusion into folk psychology. Third, I will show how phenomenologically inspired theories of delusion, such as the multiple realities hypothesis, bypass the debates above and focus on describing and understanding the disturbances in the structure of experience undergone by patients. I conclude that the philosophical discussions ensuing from an appreciation of double bookkeeping show some of the limitations of the analytic philosophical approach to delusion. (shrink)

This essay argues that we should find Crimmigration, which is the collapsing of immigration law with criminal law, morally problematic for three reasons. First, it denies those who are facing criminal penalties important constitutional protections. Second, it doubly punishes those who have already served their criminal sentence with an added punishment that should be considered cruel and unusual (i.e., indefinite imprisonment or exile). Third, when the tactics aimed at protecting and serving local communities get usurped by the federal government for (...) immigration enforcement purposes, they often undermine these original aims or get used in ways that conflict with the U.S. Constitution. These concerns should prompt us therefore either to reject the government’s plenary power over immigration or require the federal government to be more consistent about maintaining the separation between criminal law and immigration law. In this essay, I argue that even when they appear to help, restrictions on migration are usually only an impediment, not an aid, to cosmopolitan justice. Even though some egalitarian cosmopolitans are well intentioned in their support of migration restrictions, I argue that migration restrictions are (i) not truly cosmopolitan and (ii) will not have the kinds of consequences they expect. My argument in defense of this claim begins, in section 1, by outlining a defense of migration restrictions based on (...) egalitarian cosmopolitan grounds. Then in sections two and three, I reply to the harms this position associates with open borders and provide some reasons as to why restrictions on migration are incompatible with cosmopolitan justice.
